When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.

Types of Marketing We May Use With Your Data:

Email marketing: With your permission, we may send you emails for the sole purpose about our store, new products, sales announcements and other updates. We never sell your information with anyone. Our third party email service Mailchimp stores this information securely. This data processor we do business with is GDPR compliant with their updated privacy policy here.

Online marketing: We use Pinterest Conversion TrackingĀ (Remarketing) to advertise trigger across the Pinterest platform. PinterestĀ remarketing will display relevant Pinterest ads tailored to you based on what parts of the TriggerApp website you have viewed by placing a cookie on your machine. THIS COOKIE DOES NOT IN ANYWAY IDENTIFY YOU OR GIVE ACCESS TO YOUR COMPUTER. The cookie is used to say ā€œThis person visited this page, so show them ads relating to that page.ā€ PinterestĀ Remarketing allows us to tailor our marketing to better suit your needs and only display Pinterest ads that are relevant to you.ā€

Online remarketing: www.classycase.com also uses 3rd party vendor re-marketing tracking pixels, including the Pinterest conversionĀ tracking pixel and Facebook conversion tracking pixel. This means we will continue to show ads to you across the internet, specifically on the Pinterest and Facebook social media platform domains. As always we respect your privacy and are not collecting any identifiable information through the use of PinterestĀ or any other 3rd party remarketing system.

The third-party vendors, including Pinterest and Facebook, whose services we use ā€“ will place cookies on web browsers in order to serve ads based on past visits to our website. ā€“ Third party vendors, including Pinterest and Facebook, use cookies to serve ads based on a userā€™s prior visits to your website. This allows us to make special offers and continue to market our productsĀ to those who have shown interest in ourĀ products.

In addition to using cookies and related technologies as described above, we also may permit certain third party companies to help us tailor advertising that we think may be of interest to users and to collect and use other data about user activities on our Sites and/or Services (e.g., to allow them to tailor ads on third party services). SECTION 2 - How Shopify Processes Your Data

This Shopify Data Processing Addendum (ā€œAddendumā€) amends the Shopify Terms of Service (the ā€œAgreementā€) by and between you and Shopify Inc., a Canadian corporation with offices at 150 Elgin Street, Suite 800, Ottawa, ON, K2P 1L4, on behalf of itself and its Irish affiliate Shopify International Ltd. (ā€œShopifyā€).

1. Definitions

(a) ā€œData Protection Legislationā€ means European Directives 95/46/EC and 2002/58/EC, and any legislation and/or regulation implementing or made pursuant to them, or which amends or replaces any of them (including the General Data Protection Regulation, Regulation (EU) 2016/679);

(b) ā€œData Processorā€, ā€œData Subjectā€, ā€œProcessorā€, ā€œProcessingā€, ā€œSubprocessorā€, and ā€œSupervisory Authorityā€ shall be interpreted in accordance with applicable Data Protection Legislation;

(c) ā€œPersonal Dataā€ as used in this Addendum means information relating to an identifiable or identified Data Subject who visits or engages in transactions through your store (a ā€œCustomerā€), which Shopify Processes as a Data Processor in the course of providing you with the Services. Notwithstanding the foregoing sentence, Personal Data does not include information that Shopify processes in the context of services that it provides directly to a consumer, such as through its consumer-facing applications like Frenzy or its consumer-facing services like Shopify Pay; and

(d) All other capitalized terms in this Addendum shall have the same definition as in the Agreement.

2. Data Protection

2.1.Ā Where a Data Subject is located in the European Economic Area, that Data Subjectā€™s Personal Data will be processed by Shopifyā€™s Irish affiliate, Shopify International Ltd. As part of providing the Services, this Personal Data may be transferred to other regions, including to Canada and the United States. Such transfers will be completed in compliance with relevant Data Protection Legislation.

2.2.Ā When Shopify Processes Personal Data in the course of providing the Services, Shopify will:

  • 2.2.1.Ā Process the Personal Data as a Data Processor, only for the purpose of providing the Services in accordance with documented instructions from you (provided that such instructions are commensurate with the functionalities of the Services), and as may subsequently be agreed to by you. If Shopify is required by law to Process the Personal Data for any other purpose, Shopify will provide you with prior notice of this requirement, unless Shopify is prohibited by law from providing such notice;

  • 2.2.2.Ā notify you if, in Shopifyā€™s opinion, your instruction for the processing of Personal Data infringes applicable Data Protection Legislation;

  • 2.2.3.Ā notify you promptly, to the extent permitted by law, upon receiving an inquiry or complaint from a Data Subject or Supervisory Authority relating to Shopifyā€™s Processing of the Personal Data;

  • 2.2.4.Ā implement and maintain appropriate technical and organizational measures to protect the Personal Data against unauthorized or unlawful processing and against accidental loss, destruction, damage, theft, alteration or disclosure. These measures shall be appropriate to the harm which might result from any unauthorized or unlawful processing, accidental loss, destruction, damage or theft of Personal Data and appropriate to the nature of the Personal Data which is to be protected;

  • 2.2.5.Ā provide you, upon request, with up-to-date attestations, reports or extracts thereof where available from a source charged with auditing Shopifyā€™s data protection practices (e.g. external auditors, internal audit, data protection auditors), or suitable certifications, to enable you to assess compliance with the terms of this Addendum;

  • 2.2.6.Ā notify you promptly upon becoming aware of and confirming any accidental, unauthorized, or unlawful processing of, disclosure of, or access to the Personal Data;

  • 2.2.7.Ā ensure that its personnel who access the Personal Data are subject to confidentiality obligations that restrict their ability to disclose the Customer Personal Data; and

  • 2.2.8.Ā upon termination of the Agreement, Shopify will promptly initiate its purge process to delete or anonymize the Personal Data. If you request a copy of such Personal Data within 60 days of termination, Shopify will provide you with a copy of such Personal Data.

2.3Ā In the course of providing the Services,you acknowledge and agree that Shopify may use Subprocessors to Process the Personal Data. Shopifyā€™s use of any specific Subprocessor to process the Personal Data must be in compliance with Data Protection Legislation and must be governed by a contract between Shopify and Subprocessor.

3. Miscellaneous

3.1Ā In the event of any conflict or inconsistency between the provisions of the Agreement and this Addendum, the provisions of this Addendum shall prevail. For avoidance of doubt and to the extent allowed by applicable law, any and all liability under this Addendum, including limitations thereof, will be governed by the relevant provisions of the Agreement. You acknowledge and agree that Shopify may amend this Addendum from time to time by posting the relevant amended and restated Addendum on Shopifyā€™s website, available atĀ https://www.shopify.com/legal/dpaĀ and such amendments to the Addendum are effective as of the date of posting. Your continued use of the Services after the amended Addendum is posted to Shopifyā€™s website constitutes your agreement to, and acceptance of, the amended Addendum. If you do not agree to any changes to the Addendum, do not continue to use the Service.

3.2Ā Save as specifically modified and amended in this Addendum, all of the terms, provisions and requirements contained in the Agreement shall remain in full force and effect and govern this Addendum. If any provision of the Addendum is held illegal or unenforceable in a judicial proceeding, such provision shall be severed and shall be inoperative, and the remainder of this Addendum shall remain operative and binding on the parties.

3.3Ā The terms of this Addendum shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to principles of conflicts of laws. The parties irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of the Province of Ontario with respect to any dispute or claim arising out of or in connection with this Addendum.

How do you get my consent?

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

How do I withdraw my consent?

If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at anytime, by contacting us at our provided email on the contact us page via our website www.classycase.com

SECTION 3 - DISCLOSURE

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

SECTION 4 - STRIPE

Our store is hosted on STRIPE Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Your data is stored through Stripe's data storage, databases and the general Stripe application. They store your data on a secure server behind a firewall.

Payment:

If you choose a direct payment gateway to complete your purchase, then Stripe stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 5 - THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. These are our data processors we do business with.

Stripe: We use this service whenever a visitor to www.classycase.com makes a purchase. They are our payment gateway and other payment transaction processors. They have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

Wheelio: Which collects the name and email addresses of visitors that visit our site and want to receive email marketing from us, uses IP Auto Detection to use double opt-in to visitors from the EU to be compliant with the new GDPR laws.

Loox: A third party service we use to issue emails to customers who have purchased products from a site requesting a review of the product they purchased. A customer's name and email is used for the sole purpose of sending a follow up email requesting a review. To see their whole GDPR compliant privacy policy go here.

Mailchimp: A third party service we use to issue emails to customers who have consented to receiving updatesĀ about our store, new products, sales announcements and other updates. In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our storeā€™s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our websiteā€™s Terms of Service.
